This page contains the BuzzWisely Terms of Use and Privacy Policy. By accessing or using the BuzzWisely website, platform, applications, or services (“Service”), you agree to this Agreement.

If you do not agree, do not use the Service.

PART I — TERMS OF USE

1. Eligibility and Authority

  • You represent that you are at least 18 years old and have authority to bind yourself or the entity you represent.

2. Description of the Service

  • BuzzWisely provides an AI-powered virtual receptionist and communications platform, including automated calls, AI voice/text, scheduling, transcription, and integrations.

  • The Service is provided on a best-effort basis. No business outcome is guaranteed.

3. AI Technology Disclosure. You acknowledge:

  • The Service uses AI and automated systems

  • AI may be wrong, misleading, incomplete, or inappropriate

  • AI may misunderstand intent, accents, or context

  • AI may fail to escalate or follow instructions

You are solely responsible for reviewing outputs and determining suitability.

4. No Professional or Regulated Services

  • The Service does not provide medical, dental, legal, financial, or emergency services.

  • No professional-client relationship is created.

  • HIPAA Disclaimer: HIPAA / PHI; BAA Required; HIPAA Mode.

    • BuzzWisely is not a HIPAA business associate and does not act as a business associate unless and until BuzzWisely and you (or the entity you represent) have executed a written Business Associate Agreement (“BAA”) that is in effect.

    • If you will use the Service to create, receive, maintain, or transmit Protected Health Information (“PHI”), you must

      • (i) request and execute a BAA by emailing [email protected] (or submitting a support ticket), and

      • (ii) enable and maintain any BuzzWisely features or settings designated for HIPAA use (“HIPAA Mode”) as instructed by BuzzWisely.

    • You agree that you will not provide PHI to BuzzWisely through the Service unless a BAA is in effect and HIPAA Mode is enabled.

    • BuzzWisely may suspend or restrict PHI-related features or your access to the Service if BuzzWisely reasonably believes PHI is being processed without a BAA in effect and HIPAA Mode enabled.

5. Account Responsibility.

You are responsible for:

  • Account security

  • All scripts, prompts, workflows, and configurations

  • Accuracy of information provided to callers

  • Obtaining all legally required consents

  • Compliance with all laws

Customer Notices; Compliance-by-Configuration. You are solely responsible for (a) configuring your bot’s scripts, prompts, workflows, routing, and messages (including voicemail, SMS/email notifications, and call disclosures) to include any notices or disclaimers required by applicable law, regulation, or professional rules, including emergency-related notices where applicable (for example, “If this is an emergency, hang up and dial 9-1-1”), and (b) ensuring your configuration and use of the Service does not violate any law or regulation, including by configuring the bot to provide regulated professional advice (medical, dental, legal, or financial advice), emergency services, or other restricted or unlawful content. BuzzWisely is a technology provider only and does not review or validate your scripts or configurations for legal compliance.

6. Acceptable Use & Prohibited Use. You may not:

  • Violate laws

  • Commit fraud or impersonation

  • Record calls without consent

  • Misrepresent AI as human where prohibited

  • Collect payment card data

  • Scrape, reverse engineer, or benchmark

  • Abuse, spam, or overload the system

  • BuzzWisely may suspend or terminate any account that creates legal, operational, reputational, or carrier risk.

7. Fair Use & Rate Limits

  • BuzzWisely may impose usage limits, throttling, or restrictions at any time.

8. Telephony & Emergency Disclaimer

  • The Service depends on third-party carriers.

  • No guarantee of call delivery, quality, or number availability.

  • NO EMERGENCY USE. No 911 support.

9. TCPA & Communications Compliance

  • You are solely responsible for compliance with TCPA, call recording, Do-Not-Call, and messaging laws.

  • BuzzWisely is only a technology provider and disclaims all liability.

10. Data, Recording & Retention. Calls and messages may be recorded or transcribed.

  • You are responsible for obtaining all required consents.

  • No guarantee of data retention or availability.

11. Security Disclaimer

  • No system is 100% secure. You accept the risk of breaches, interception, or leaks.

12. Intellectual Property

  • BuzzWisely owns the platform, software, models, and systems.

  • You retain your content but grant BuzzWisely a license to use it to operate, maintain, and improve the Service, including anonymized and aggregated analytics.

13. Third-Party Services

  • BuzzWisely is not responsible for third-party outages, changes, or failures.

14. Billing, Subscriptions & Taxes

  • Fees are charged in advance

  • Subscriptions may auto-renew

  • All fees are non-refundable

  • You are responsible for all taxes and telecom surcharges

  • Improper chargebacks may result in termination.

15. PCI & Payment Data Prohibition

  • The Service is not PCI compliant. You must not collect or process payment card data using the Service.

16. Phone Numbers

  • Numbers are provided by third parties and may be lost, reclaimed, or non-portable. BuzzWisely is not liable for number loss.

17. Beta Features

  • Some features may be experimental and provided as-is.

18. No Authority

  • The Service cannot bind you or your business to any commitments.

19. Fraud & Impersonation

  • BuzzWisely does not guarantee prevention of fraud or social engineering.

20. Minors

  • You must not knowingly collect data from children under 13.

21. Accessibility

  • BuzzWisely does not guarantee accessibility compliance.

22. Export Controls

  • You agree to comply with all export and sanctions laws.

23. Legal Requests

  • BuzzWisely may disclose data if legally required.

24. AI Behavior Changes

  • AI behavior may change over time. No consistency is guaranteed.

25. No Third-Party Reliance

  • No third party may rely on the Service outputs.

26. Synthetic Voice Disclaimer

  • All voices are synthetic and not real persons.

27. Disclaimer of Warranties

  • THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” ALL WARRANTIES ARE DISCLAIMED.

28. Limitation of Liability

  • To the maximum extent permitted by law, BuzzWisely is not liable for indirect or consequential damages. Total liability shall not exceed the amount paid in the prior 12 months.

29. Indemnification

  • You agree to indemnify BuzzWisely for claims arising from your use, content, or violations.

30. Termination

  • BuzzWisely may suspend or terminate at any time. Data retention is not guaranteed.

31. Governing Law & Arbitration

  • Delaware law governs. All disputes resolved by binding arbitration. No class actions.

32. Injunctive Relief

  • BuzzWisely may seek court orders for abuse, scraping, or IP violations.

33. Force Majeure

  • BuzzWisely is not liable for events beyond its control.

34. Assignment

  • BuzzWisely may assign freely. You may not without consent.

35. Severability

  • Invalid clauses do not affect the rest.

36. Waiver

  • No waiver unless in writing.

37. Survival

  • Key legal sections survive termination.

38. Entire Agreement

  • This Agreement is the entire agreement between you and BuzzWisely.

PART II — PRIVACY POLICY

39. Information We Collect. We may collect:

  • Account information (name, email, company)

  • Call metadata and recordings

  • Messages and transcripts

  • Usage data and logs

  • Billing and subscription data

  • Device and browser information

40. How We Use Information. We use information to:

  • Operate and provide the Service

  • Process calls and messages

  • Provide support

  • Improve the platform and AI systems

  • Prevent abuse and fraud

  • Comply with legal obligations

41. Call Recording & Communications

  • Calls and messages may be recorded or transcribed.

  • You are responsible for obtaining all required consent from callers.

42. Data Sharing. We may share data with:

  • Infrastructure, AI, telephony, and hosting providers

  • Payment processors

  • Legal authorities if required

  • We do not sell personal data.

43. Data Retention

  • We do not guarantee any specific retention period. Data may be deleted at any time.

44. Security

  • We use reasonable safeguards but no system is completely secure.

45. Your Responsibilities. You are responsible for:

  • Lawful data collection

  • Providing notices to callers

  • Compliance with privacy and recording laws

46. International Use

  • Data may be processed in the United States or other countries.

47. Children’s Privacy

  • The Service is not intended for children under 13.

48. Legal Disclosures

  • We may disclose information if required by law or legal process.

49. Changes

  • We may update this Agreement at any time. Continued use means acceptance.
